Terms and Conditions
1. Definitions
“We”, “us”, “our”, “QuizQuizQuiz” or “QQQ” means QuizQuizQuiz Limited, whose registered address is: 29 Newton Avenue, London, W3 8AR. The company number is: 05401782.
“‘The Client” or “you” means the person, firm or company or their representative to whom we provide the Quiz.
“Quiz” means a quiz event or any associated quiz services provided by QuizQuizQuiz, and shall include the provision of quiz questions, the running, attending or setting up of a quiz and the general giving of advice or carrying out of a chargeable service for you.
2. General
A contract for the provision of a Quiz will come into force when you sign and return a copy of these terms and conditions to QQQ or when you give email confirmation to us of your acceptance of these conditions, whichever occurs first.
This agreement forms a binding contract between QQQ and you. The contract may only be varied with the written agreement of both parties. Your rights under this contract may not be resold, assigned or transferred without the written consent of QQQ.
3. Payment
Payment terms can be found on your invoice. You must pay in full within 30 days of the issue date of each invoice. The person whose signature is on the bottom of this agreement or the person on behalf of whom the agreement is signed is responsible for ensuring that QuizQuizQuiz is paid according to the terms and conditions. Interest may be charged on late payments and will be calculated on a daily basis at an annual rate of 3% over the base rate current from time to time of National Westminster Bank plc. Interest will continue to accrue from the date that payment became due up to and including the date that full payment is received by us.
All prices quoted to you are exclusive of VAT unless otherwise stated. Your invoice will show the gross price to be paid by you. QuizQuizQuiz is VAT-registered.
4. Booking and Cancellation
All bookings will be regarded as provisional until a signed contract or email confirmation accepting these terms and conditions is received by us. The following cancellation fees apply when confirmed bookings are cancelled by you:
Cancellation on the date of the Quiz: Full price of the Quiz
Cancellation between 1 and 5 days before the Quiz: Half of the full price of the quiz
Cancellation between 6 and 14 days prior to the Quiz: £50
Cancellation 15 days or more before the Quiz: No charge
Cancellation fees will be subject to interest as detailed above if not paid within 30 days of the issue date of the invoice.
5. QuizQuizQuiz’s Responsibilities
QuizQuizQuiz will maintain public liability insurance of £5 million for accidents caused by our negligence or the failure of our equipment.
QuizQuizQuiz will ensure that all relevant equipment supplied by us for use during your quiz has passed Portable Appliance Testing.
6. Your Responsibilities
Unless agreed in writing otherwise, the client is required to provide electricity at the venue. This must consist of a minimum of one 13 amp power socket within a 5m distance of the quizmaster.
The client is required to provide suitable furniture and sufficient space for the QuizQuizQuiz team and their equipment. Details will be advised prior to the Quiz.
7. Confidential Information
No questions or materials may be used or distributed, other than for the Quiz for which they were supplied, without the express permission of one of the QQQ directors. ‘Questions and materials’ includes - without limitation - all QQQ questions and answers, all QQQ physical quiz property such as picture rounds or question sheets, and all QQQ multimedia (pictures/sounds).
QQQ owns the copyright in all written questions and answers used during the Quiz unless otherwise stated. We take care to verify our questions and answers, but cannot guarantee their accuracy, and cannot be held responsible for any errors or misunderstandings that may occur.
8. Force Majeure
QQQ will make every effort to ensure that it meets its obligations to you, but it is not liable if it fails to do so due to circumstances beyond its control, including, but not limited to: fire, flood, illness, war, terrorism, strikes, power failure or accidents.
9. Limitation of Liability
To the extent permitted by law and except as expressly provided to the contrary in this agreement, all warranties whether express, implied, statutory or otherwise, relating in any way to the subject matter of this agreement or to this agreement generally, are excluded.
Where legislation implies in this agreement any condition or warranty and that legislation avoids or prohibits provisions in a contract excluding or modifying the application of or the exercise of or liability under such term, such term shall be deemed to be included in this agreement. However, the liability of QQQ for any breach of such term shall be limited to the supplying of the Quiz again, or the payment of the cost of having the Quiz supplied again.
To the extent permitted by law and except as expressly provided to the contrary in this agreement, QQQ shall not be under any liability (contractual, tortious or otherwise) to you in respect of any loss or damage (including, without limitation, consequential loss or damage) howsoever caused, which may be suffered or incurred or which may arise directly or indirectly in respect to the supply of goods or services pursuant to this agreement or the act, failure or omission of QQQ.
10. Law & Jurisdiction
These conditions are governed by the law of England and Wales and the parties submit to the exclusive jurisdiction of the courts of England and Wales.
